Controller of personal data
The controller of your personal data is R. Podświadek i Wspólnicy Kancelaria Prawna sp.k. (hereinafter: RP&W) with its registered office in Warsaw (address: Bukowińska 24 A street, 111, 02-703 Warsaw). Data collected by RP&W are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter “GDPR”), the Act of 10 May 2018 on the protection of personal data and other legal provisions regarding the protection of personal data.

The scope and purposes of personal data processing

As part of its activities RP&W collects and processes personal data:

  1. for the purposes of the legitimate interests pursued by RP&W as data cotroller, i.e. to provide services to clients, answer customer inquiries and inform clients about changes in legal provisions – pursuant to art. 6 par. 1 lit. f GDPR
  2. in order to perform contracts concluded by RP&W with clients, contractors, suppliers and other entities, including, but not limited to, contacting representatives and employees of clients and their contractors, contractors of RP&W, suppliers and other entities – pursuant to art. 6 par. 1 lit. b GDPR
  3. to employ people interested in cooperation with RP&W – pursuant to art. 6 par. 1 lit. a, b, c GDPR for compliance with a legal obligation to which the controller is subject
  4. for compliance with legal obligations to which RP&W is subject – pursuant to art. 6 par. 1 lit. c GDPR).

The period for which the personal data are processed

The processing of your personal data takes place on a voluntary basis. However, in the case of concluding an agreement with RP&W, the provision and processing of data is necessary for the performance of the contract. Your personal data will be stored for the duration of the contract until the expiration of the time limits for claims arising from non-performance or improper performance of the above-mentioned contract. In the case of court proceedings, your data will be processed for a period of 10 years from the end of the year in which the court proceedings ended. In case of answering a question, your data will be processed no longer than it is necessary to answer you, and after that time may be processed during the period of prescription of possible claims. All data processed for accounting purposes and for tax reasons will be processed for 5 years counted from the end of the calendar year in which the tax obligation arose. After the above-mentioned periods, the data will be deleted or anonymized.

The right to lodge a complaint

You have the right to lodge a complaint to the President of the Personal Data Protection Office.

Other rights

You have the right to request from RP&W the access to your personal data, the right to demand the rectification, the erasure or restriction of processing and the right to portability, and in the event of consent – the right to withdraw consent at any time. In some cases you will not be allowed to execute these rights e.g. in case of performance of the contract especially if it is a contract for legal services.

Transfer of personal data to third parties

The recipients of your personal data may include in particular: external service providers (e.g. IT services providers), entities authorized on the basis of legal provisions (administrative bodies, authorities, courts).

Your personal data is processed at the headquarters of RP&W. Personal data is not transferred to countries and international organizations outside the European Union. In the event of transfer of personal data to third countries or international organizations located outside the European Union, RP&W will use appropriate instruments to ensure the security of your personal data.

No profiling

Your personal data is not subject to profiling as one of the forms of automated processing of personal data.

Cookies policy

Cookie files (so-called “cookies”) are files, in particular text files, which are stored in the Your end device (computer, laptop, phone, etc.)  and are intended for improving the use of the  websites You are visiting. Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.

Session cookies are stored in the end device until the browser is switched off and the permanent cookies  for the time specified in the cookie file parameters or until they are deleted by the user.

The RP&W website may place a cookie in Your browser, if Your browser allows it. You can always limit or disable the possibility of placing cookies by us by changing the settings of your browser. However, this may prevent You from using certain features of our website or cause it to be displayed incorrectly.

Cookies are not used to determine the identity of the user.

RP&W may use cookies and other similar technologies to provide services or adapt our website to your preferences and optimize the use of the website.
